Whether foreign nationals living in Brazil can change their first name without returning to their home country is a complex question, surrounded by debate over personal identity and how the law adapts to a globalized society. Under current Brazilian law, the answer is no.

Identity and globalization

A person's first name is a core element of individual identity. As global mobility increases, many immigrants find themselves in situations where adjusting their first name would be key to adapting and integrating. Allowing this change in Brazil could give them a greater sense of belonging and make it easier to become part of society.

Legal limitations

Under the Brazilian Civil Code and Brazil's civil registry rules, name changes must be made in the person's country of origin. This rule is meant to keep civil records consistent, but it creates significant difficulties for those who want or need to adjust their name for cultural or personal reasons.

Name discrepancies

It is common for the name on immigration documents issued by the Federal Police to differ from the name on birth records from the country of origin. In these cases, the law allows the individual to request a correction from the Federal Police. If the request is denied, the person may seek relief in court through a writ of mandamus (mandado de segurança).

The need for reform

There is an urgent need to revise Brazilian law to allow foreign nationals to change their first name in Brazil. This would reflect the realities of a globalized society and promote greater integration and inclusion of immigrants.

Conclusion

Allowing foreign nationals to change their first name in Brazil without having to return to their country of origin would be a significant step forward in the recognition of individual rights. This change would strengthen immigrants' sense of belonging and highlight Brazil as a welcoming and inclusive country.
